“Can’t I just tell the bank it’s my primary residence?”
No — and it isn't a grey area. Misrepresenting occupancy on a mortgage application is fraud. In my own words: "this is a big NO, NO, could wind you up in jail." Ask me how the financing genuinely differs instead.
It comes up often enough that it stays on my list of most-asked questions. The financing genuinely does differ between a primary residence and an investment property — rates, down payment and reserves — and the honest route through it is a conversation with a lender, not a misstatement on an application.
